Who Can Make a Claim?

If you were involved in a road traffic accident that wasn't entirely your fault, you could be entitled to compensation — regardless of how you were travelling at the time.

🚗

Car Drivers & Passengers

Rear-end shunts, roundabout collisions, side impacts, motorway pile-ups, and multi-vehicle crashes. Even passengers in the at-fault car can claim.

🚲

Cyclists & E-Bike Riders

Dooring incidents, left hooks, close passes, lorry blind spots, and injuries from potholes or poor road surfaces. Cycling claims often result in higher payouts due to severity of injuries.

🚶

Pedestrians

Hit by a vehicle at a crossing, on a pavement, or in a car park. Also covers injuries caused by e-scooters, cyclists on pavements, or dangerous road surfaces.

🏍️

Motorcyclists

SMIDSY collisions ("Sorry mate, I didn't see you"), junction pull-outs, lane changes, and road surface hazards. Motorcycle injuries are typically more serious and attract higher compensation.

🚌

Bus & Tram Passengers

Emergency braking injuries, collisions, slips and falls while boarding, and injuries caused by the vehicle moving before you were seated.

👨‍👩‍👧

Family of Victims

If a family member was seriously injured or lost their life in a road accident, you may be able to claim on their behalf. Bereavement awards and dependency claims are available.

How Much Could You Receive?

Compensation depends on the type and severity of your injury, how it's affected your life, and any financial losses. Here are typical ranges based on the Judicial College Guidelines used by UK courts:

Injury TypeTypical Range
Minor whiplash (recovery within months)£240 – £4,345
Moderate neck/back injury£7,890 – £38,490
Serious back injury (long-term impact)£38,780 – £160,980
Fractured arm or wrist£6,610 – £36,770
Knee injury (moderate to serious)£14,840 – £54,830
Shoulder injury£7,890 – £48,030
Psychological injury (PTSD, anxiety)£1,540 – £57,650+
Serious head/brain injury£43,060 – £379,100+
Fatal accident (bereavement award)£15,120 statutory + dependency

These are general damages only (pain and suffering). Your total settlement may also include special damages such as lost earnings, medical expenses, travel costs, care costs, and vehicle damage — often adding significantly to the final amount. Every case is unique and these figures are guidelines, not guarantees.

Time limit: 3 years from the date of the accident

Under the Limitation Act 1980, you generally have 3 years to start a claim. After that, your right to compensation may be lost entirely. The sooner you act, the easier it is to gather evidence and the stronger your case will be.

What Can You Claim For?

Compensation covers both the physical and financial impact of your accident. Here's what a successful claim typically includes:

Pain and suffering — compensation for physical injuries and discomfort
Lost earnings — time off work during recovery, including future loss
Medical expenses — treatment, prescriptions, rehabilitation, physio
Travel costs — getting to hospital, appointments, and alternative transport
Vehicle damage — repair or replacement costs for your car or bicycle
Care and assistance — even unpaid help from family counts
Psychological impact — anxiety, PTSD, driving phobia, depression
Loss of amenity — impact on hobbies, social life, and daily activities

Common Questions

Does it cost me anything to make a claim?
No. Our partner solicitors work on a No Win, No Fee basis (formally called a Conditional Fee Agreement). If your claim is unsuccessful, you don't pay anything. If they win, their fee is a percentage of the compensation — agreed upfront so there are no surprises. You'll never be out of pocket.
How long do I have to make a claim?
In England and Wales, you generally have 3 years from the date of the accident. For children, the 3-year period starts when they turn 18. For people lacking mental capacity, there is no time limit while the incapacity continues. Regardless of the deadline, acting quickly means better evidence and a stronger case.
What if I don't know who hit me (hit and run)?
You can still claim. The Motor Insurers' Bureau (MIB) handles claims involving untraced or uninsured drivers. Our partner solicitors deal with hit-and-run cases regularly and will guide you through the MIB process. The compensation may be calculated slightly differently, but you are still entitled to make a claim.
What if I was partly at fault?
You can still claim. This is called "contributory negligence" and it means your compensation is reduced proportionally. For example, if you were found 25% at fault, you'd receive 75% of the full amount. Common examples include not wearing a seatbelt or crossing at an undesignated spot. As long as you were less than 51% responsible, you have a valid claim.
What information do I need to provide?
As much as you can — the road, date and time, what happened, any injuries, witness details, and photos. But don't worry if you're missing information. That's exactly what the solicitor helps you gather. Our platform's incident records (timestamped road data, closure durations, severity) can also support your case as independent evidence.
Can I claim as a cyclist or pedestrian?
Absolutely. Cyclists and pedestrians are among the most vulnerable road users and often receive significant compensation because their injuries tend to be more serious. Specialist cycling solicitors handle cases including dooring, close passes, lorry collisions, and pothole injuries. You can also claim against local councils for dangerous road conditions.
Will I have to go to court?
Very unlikely. The vast majority of road traffic accident claims — over 95% — are settled through negotiation with the other party's insurer, without any court involvement. Court proceedings are only necessary when fault is seriously disputed or a fair settlement can't be reached. If it does go to court, your solicitor handles everything.
How long does a claim take?
A straightforward road traffic accident claim typically settles within 4 to 9 months. More complex cases involving serious injuries, disputed liability, or ongoing treatment can take 1 to 3 years. Once a settlement is agreed, you usually receive your money within 14 to 28 days.
